Terms and Conditions of Distance Selling

Welcome to Silent Home, a Portuguese decoration, furniture, design and homeware brand.

Scope

These terms and conditions govern the use of this website and the form of contracts for the purchase and sale of products and the provision of services concluded at a distance, under the terms of Decree-Law no. 24/2014 of 14 February.

Use of our website and confirmation of a purchase implies acceptance of these terms and conditions, as well as the following PRIVACY POLICY.

Products

Silent Home offers a variety of decorative items and furniture. We make every effort to ensure that the images, descriptions, prices and availability of the items available in our online shop are as accurate as possible. However, products may differ slightly from one another due to the materials and production processes used. We supplement the images with information on the characteristics of each product.

Prices and Payment

All prices are in Euros (€) and include VAT. legal rate in force. We reserve the right to change prices at any time and without prior notice. Accepted payment methods include debit, credit, MBway and ATM cards. For ATM payments, the payment period is 24 hours.

Invoicing

Upon completion of the purchase process, you will receive the transaction invoice in digital format to the email address provided by the customer at the time of checkout.

Delivery service

Silent Home offers a home delivery service for the whole of Portugal and Spain, with or without assembly, according to the customer's requirements. price list available on the website.

Delivery timesThe estimated delivery time for each product will be indicated at the time of check-out and sent later in the order confirmation by e-mail.

For small shipments (up to approximately 30kg), our delivery service will be carried out via DPD, and the assembly service is not available.

For larger shipments (over 30kg), our service will be carried out by Silent Home or our delivery partners. The assembly service is available exclusively in mainland Portugal.

For large deliveries (weighing more than 30kg) and after payment of the order and confirmation that the products are available, Silent Home will contact you to arrange delivery.

Delivery of orders to the islands (Azores, Madeira and the Spanish islands) may take longer due to the constraints inherent in the type of transport.

Shipping costs: Shipping costs are calculated at the checkout and vary according to the destination and the weight of the products.

In the event of a justifiable impediment, the agreed delivery date may be altered without Silent Home being liable for this.

This service does not include deliveries that involve lifting or using cranes through windows or balconies, affixing to walls and ceilings or any type of electrical installation.

Before placing any order with Silent Home, the buyer should check the measurements of the products, as they are responsible for any problems inherent in manoeuvring or passing the products through entrances, corridors, doors, lifts or stairs at the place of delivery. Silent Home cannot be held responsible if these factors are not taken into account by the customer, and in the event of a return, the costs of delivery will be borne by the customer.

Ownership of the products transfers to the buyer once the order has been paid for in full and delivered or collected.

Silent4You Service

At Silent Home, we have an interior design consultancy and counselling service called Silent4You.

The aim of this service is to advise and recommend the Silent Home items best suited to your space and lifestyle.

Depending on the geographical location, type and size of the project and the availability of our team, Silent Home reserves the right to analyse the feasibility of carrying out this service.

The products suggested in Silent4You projects do not guarantee a reservation or pre-purchase for the client and are, of course, subject to purchase by other clients.

Conditions for cancellation and return

As a consumer of goods at a distance, the customer has the right to cancel the sales contract within 14 days of receiving the products, provided that they: are in perfect condition, show no signs of use, have not been assembled, are in their original packaging and retain their original labels.

Silent Home will check the above conditions, and if they do not comply, the customer loses the right of withdrawal. You are responsible for collecting the products from our premises within 30 days.

To start the Returns process: the customer must contact us at info@silenthome.com to inform us of their intention to withdraw from the contract and state the reason for this, together with the order details and the item(s) to be returned.

The customer is responsible for sending the goods back, and will be responsible for the costs involved.

After Silent Home confirms receipt of the intention to withdraw, the customer has 14 days to have the product(s) delivered to the following address:

Returns of goods to our shop require prior information on estimated delivery and/or tracking number. The hours for receiving returns for online purchases are Monday to Friday from 10am to 6pm (except national holidays and places where the shop is closed). Silent Home cannot be held responsible for any loss or damage to goods caused by the means of transport contracted by the customer.

Refunds will be processed within 14 days of receipt and inspection of the returned products. Refunds will be made using the same payment method used for the purchase.

Amounts paid by the customer for the transport and/or assembly service, after they have been confirmed and booked, do not entitle the customer to a refund.

Silent Home may, exceptionally and for logistical reasons, cancel the order for justifiable reasons, refunding the amounts paid for it, and the customer may not be required to pay any compensation.

If Silent Home is unable to deliver the products to the buyer after 6 months from the first delivery attempt, Silent Home may dispose of the products without the buyer being entitled to a refund of any amount paid.

Product guarantee

For products purchased from Silent Home, the legal guarantee period in force will apply.

Privacy and Processing of Personal Data

The personal data collected during the purchase process will be processed in accordance with our Privacy Policy which can be found on our website.

Registration

In order to take advantage of additional features, you can register as a customer on our website. It is the user's responsibility to ensure the confidentiality and viability of the chosen password.

The information filled in by the user must be true and up-to-date. Any damages arising from false or incomplete statements made by the user are the sole and exclusive responsibility of the user. Silent Home shall not be held liable for any damages arising from improper use of the website by the user or third parties.

Intellectual Property

All content on this website, including text, images, graphics, symbols and logos, is the property of Silent Home or its suppliers and is protected by copyright and intellectual property laws. The user of this website undertakes to respect such rights and laws.

The user of this site is not authorised to publish, reproduce, modify, copy, sell or distribute any information on this site without prior written authorisation from Silent Home.

Use of the site

This site is intended exclusively for viewing the Silent Home product catalogue and purchasing products, as well as strategic means of consulting the newsletter/blog and marketing campaigns. The user of this site undertakes to respect these terms and conditions and to use this site responsibly and honestly, and must not attempt to use it for any purpose other than that for which it was intended.

The user of this site recognises that by using this site he/she accepts these terms of use, as well as the privacy policy.

Limitation of Liability

Silent Home shall not be liable for any indirect, incidental or consequential damages resulting from the use or inability to use the website or the products purchased through the website.

Silent Home does not assume any legal duty with regard to the information on the website not being completely accurate, up-to-date, complete and error-free.

Silent does not guarantee that the functionalities, qualities or characteristics of the products, services, information or other content published on the site will fulfil users' expectations.

Silent Home shall not be liable for errors that may occur due to mistakes, irregularities or failures in the system or the website (temporary or permanent).

Silent Home accepts no liability for damage resulting from improper use of the site or the inability to use it.

Changes to the Terms and Conditions

We reserve the right to change these terms and conditions at any time. Amendments will take effect from the moment they are published on our website.

If any part or provision of these terms is unenforceable or conflicts with applicable law, the validity of the remaining parts or provisions shall not be affected.

Applicable Law and Jurisdiction

These terms and conditions are governed by Portuguese law. Any dispute arising from the interpretation or execution of these terms and conditions shall be submitted to the competent jurisdiction of the District of Lisbon, expressly waiving any other jurisdiction.

If you have any questions about our products or services, or any questions relating to these terms and conditions, you should contact our customer service department at info@silenthome.com, or by telephone on +351 213 870 176.

Complaints

Any product found to be defective by the customer should be reported as soon as possible with photographic evidence to info@silenthome.com.

Photographic evidence will be analysed and may need to be analysed in person by our team, and the transport of the products to be analysed is the responsibility of the client.

The analysis by our quality department can take between 1 and 3 weeks.

Silent Home cannot be held responsible if an item suffers damage as a result of improper use or contact with any type of chemical or organic product that may damage the products, and it is the customer's responsibility to preserve or repair them.

If an item is found to be faulty or cannot be repaired, the customer will receive a credit note for the amount paid for it, to be used in our shop for a period of 1 year.

If, on receipt of your order, you notice any non-conformity in the products delivered, you must notify us by emailing info@silenthome.com within 5 days of receiving them.

For subsequent claims within the guarantee period, please contact us via the same email address.

When the item in question is within the legal guarantee period, our team will assess whether the claim is within the scope of the guarantee. If it is under warranty, Silent Home will repair it whenever possible, or replace it with the same or a successor product of comparable value.

Variations in materials inherent to the products produced are not considered defects, and the seller cannot guarantee that items made from natural products (such as wood, stone, bamboo, leather, eco-skin, resin or similar items) or with handcrafted finishes are exactly the same or that their characteristics will not change with the passage of time and normal use.

Silent Home is not responsible for the normal depreciation or perishing of the items as a result of the use and maintenance given to them by the buyer.

Changes to the Terms of Use

This website was created, is owned and operated by Silent Home - designated as Silent Home Lda, with registered office at Rua Joaquim António de Aguiar n 70B, 1070-153 Lisboa , Portugal, a company limited by shares, nif 515574821, from the R.N.P.C. commercial registry office and with share capital of €100.00, with the trading name of Silent Home, its use being governed by these terms.

Silent Home reserves the right at any time, without prior notice and with immediate effect, to alter, add to, update or delete, in part or in full, these terms of use.

It is the user's responsibility to consult these terms and conditions regularly, in order to be up to date with any updates or changes.

If you do not agree with any of these rules of use, you should not use the site.
